Final Judgment Agreement

(3) Pending the final judgment, the defendants comply with counsel`s provisions following the conclusion of the amended and revised investment agreement of January 31, 1994 (and related agreements) or a similar agreement between a defendant and British Telecommunications plc (“BT”). This obligation is not affected by the implementation date of agreements between the defendant and BT, which require BT to provide the MCI and NewCo information necessary to meet the requirements of Sections II.A.1 to 6. These agreements, which are implemented before the execution is handed down, are in accordance with the provisions of Section II.B-D of the prison court and are submitted to the Ministry of Justice during the execution. 4. Disclosure agreements to U.S. companies covered by Section IV.E of the final judgment provide that (1) non-public information received by the Department of Justice is intended to file a complaint or pass on information to government authorities in the United States or the United Kingdom, and to any conduct that may be the subject of such a complaint or the provision of information to identify and assess internally. , but should not be used for the sale or marketing of the company`s services; 2. This information may not be shared with persons other than company officials, directors, employees, representatives or contractors, or government authorities in the United States or the United Kingdom (including, but not only the Federal Communications Commission and OFTEL); (3) anyone to whom the information is disclosed is informed of restrictions on the use and disclosure of information; and (4) In the event of unauthorized use or disclosure, the Department of Justice may revoke or restrict the company`s access to such information, unless the department decides, at its sole discretion, that the revocation of access is inappropriate. The applicant may, at his sole discretion, include other conditions in such agreements. All actions taken by the Department to remedy unauthorized use or disclosure will not be affected or will not create any ability for NewCo or MCI to separately prosecute individuals who receive such information from the division, all remedies for unauthorized use or disclosure.
